Ashley St. Clair sues Elon Musk for custody of his alleged 13th child, claims he said: ‘I want to knock you up again’

Ashley St. Clair filed a paternity suit against Elon Musk Thursday and is also seeking sole legal custody of her newborn son, according to court documents obtained by Page Six.

The 26-year-old claimed in the paternity petition that she began dating the SpaceX CEO, 53, in May 2023 and they then had sex on or around Jan. 2, 2024 and Jan. 3, 2024, which is when she believes her son was conceived. The child’s official birth date and name were redacted but his first initial is “R.”

St. Clair said in the filing that she is confident Musk is the father because she “did not have sexual intercourse with any other male during the time the child was conceived.”

She asked the court to order the Tesla CEO to undergo genetic testing to determine her child’s paternity.

Reps for Musk declined Page Six’s request for comment.

St. Clair provided the court with a series of text messages in an effort to prove that the billionaire businessman had a relationship with her and acknowledged at one point that he was the child’s dad.

Per the court docs, the new mom sent Musk a photo of herself holding her baby boy at the hospital, to which he allegedly replied, “I look forward to seeing you and him this weekend.”

She then claimed the X owner wrote her on Nov. 24, 2024, “I want to knock you up again” and reiterated a similar sentiment as recently as Feb. 2, 2025, saying, “Well, we do have a legion of kids to make.”

Earlier this week, the pair’s spicy online messages also resurfaced, in which they appeared to openly allude to different sex positions.

St. Clair notes in the court documents that she is not seeking child support from Musk “at this time” but requested that a temporary order of support be made “for the child.”

In an additional filing, the conservative activist said she wants sole and legal custody of her son.

“I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments,” she argued in the docs.

“I am the only parent who cares for him on a daily basis. I feed him, bathe him and ensure that all his physical and emotional needs are met.”

St. Clair claimed that Musk was not present for the birth of his alleged child — even though he was allegedly given the opportunity to be there — and has “not expressed interest” in having custody.

She further claimed that the tech mogul has only met with her son three times, including on Sept. 21, 2021 for two hours in New York, then for on one hour the following day and, lastly, on Nov. 30, 2024 for 30 minutes in Austin, Texas.

“Respondent has never asked to see our child on any other occasion, he has never communicated to me about our child without my prompting, he has never asked for photos of our child or checked in after doctor’s appointments,” she added in the filing.

St. Clair first revealed she had allegedly welcomed a child with Musk via X earlier this month.

“Five months ago, I welcomed a new baby into the world. Elon Musk is the father,” she wrote on Feb. 14.

“I have not previously disclosed this to protect our child’s privacy and safety, but in recent days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.”

St. Clair said in her recent filings that she “tried to handle this privately so that it did not become public.”

Musk — who would have 13 children altogether with St. Clair’s son — has not issued a public statement on the matter, but his 21-year-old estranged daughter Vivian has called him out over it.

She wrote via TikTok, “Wow, if I had a nickel for every time I found out I had half-siblings through Reddit, I’d have two nickels… which isn’t a lot but it’s weird that it’s happened twice, right?”

Aside from his legal issues with St. Clair, Musk is also battling his ex Grimes for the custody of their three children: X Æ A-Xii, 4, and Techno Mechanicus, 2, and daughter Exa Dark Sideræl, 3.

On Thursday, the Canadian singer, 36, accused the businessman of ignoring her when one of their kids had a “medical crisis.”

She wrote via X, “I’m not giving any details but he won’t respond to texts call or emails and has skipped every meeting and our child will suffer life long impairment if he doesn’t respond asap, so I need him to f–king respond and if I have to apply public pressure then I guess that’s where we are at.”
