Author Ashley St Clair sues Elon Musk following claim she'd given birth to his 13th child

Elon Musk is being taken to court over the birth of what author Ashley St Clair is claiming is his 13th child.

The 26-year-old announced on social media last week that her five-month-old son is fathered by the world's richest man, and has now filed a petition for sole legal custody to the New York Supreme Court, yesterday (February 21).

Court documents identify the child as only RSC, with St Clair having previously pleaded with the media to 'honor our child's privacy, and refrain from invasive reporting'.

Texts between the pair have been provided to the court as evidence. In one exchange, which notably took place before President Donald Trump won the presidential election in November, Musk urges St Clair to stay quiet.

He writes: "I get credible death threats everyday.

"I'm #2 after Trump for assassination.

"Wake up.

"This is not the time for sentiment at the expense of safety.

"If I make a mistake on security, R[full name blacked out] will never know his father."

St Clair responds: "That's why the father spot on his birth certificate is blank right now, E.

"And why he has my last name."

One minute later, Musk texts: "Necessary for now.

"Only the paranoid survive."

St Clair replies: "I understand. Apologies it Eva's text upset you. There has been incredible discretion used here as will continue to be."

Before Musk concludes: "The threat level will reach insane levels until the election is decided.

"Loose lips sink ships."

In the court filing, St Clair, a conservative activist who has written a children's book titled Elephants Are Not Birds - which takes aim at the transgender movement, claims that Musk did not attend his 13th child's birth.

While also saying the Telsa CEO 'has met him only three (3) times and has had no involvement in his care and upbringing'.

As well as the custody petition lodged with the court, St Clair has also file a paternity petition where she explains the pair began a 'romantic relationship in or about May 2023', and how they slept together in January of last year - when RSC was conceived, with the infant being born in September 2024.

Following RSC's birth, St Clair states how she sent a picture to Musk of her and her new baby to which she alleged he replied: "I look forward to seeing you and him this weekend."
