Joe Budden has opened up about how he was able to beat his lewdness case, in which he was accused of trying to enter a neighbor's property while fully nude.
At around the 16:30 point of the latest episode of The Joe Budden Podcast, as seen above, the rapper-turned-podcaster opened up about his recent absence from the show and gave a breakdown of what led to the lewdness charge and how he was cleared of it. He explained that he had been dealing with these "racist" neighbors for months, complaining about anything they possibly could for months.
On Dec. 4, Budden was captured on surveillance video sleepwalking and attempting to enter the same neighbor's apartment while fully nude. In the video, Budden appeared to try to enter the code for the door before leaving back to his own apartment. Budden has been open about his issues with sleepwalking in the past, but this is the first time he's had to go to court over it.
"These people decided to misuse some of the systems that are in place for real victims," he said at the 19:30 point. "They went to the police to file a report to say that Joe Budden was outside of their door masturbating and they don't know if I was there with the intention to 'r-word' her and her family. So, what seemed like a simple sleepwalking medical condition turned into something much bigger. So I've been gone [from the podcast] for a month, 'cause I had a civil suit."
He claimed that on the first day of the trial, his "Karen" neighbor took the stand and "cried immediately" with "white girl tears." He said the civil lawsuit accused him of stalking and lewdness, the latter of which he explained only applies if the accused is naked with the intent to "sexually gratify" themselves.
"She lied on that paperwork to say he was masturbating on my door, as if I can't find a million better places to masturbate than that," he continued. "My lawyer asked her if she thought that I was fully erected in the video. She said, 'Yes.' ... So that was a big point of contention during this civil trial. He touched his penis in this video, so was he masturbating? She says, 'Yes.'"
At one point he thought about bringing his doctor into the trial, but it would have further dragged out the proceedings. Instead, he brought his girlfriend to the stand to testify that he was not, in fact, fully erect. The admission caused his co-hosts to erupt into laughter and Budden called his girlfriend to laugh about it too. "Was he flacid?" he asked her, to which she replied, "Absolutely not!" He later laughed, "I'm a grower, not a show-er."
He also thanked the judge in the case for being fair during the trial. "Mr. Budden was not erect. He was not masturbating," he said the judge explained when clearing him. "The one time that he touched his penis, he appeared to be trying to cover himself. Mr. Budden was not trying to forcibly enter. ... She was fair, reasonable, heard all the testimony, was attentive, wasn't on no bullshit."
