The man suing Diddy over an alleged sexual assault demanded a massive judgment in court days after the disgraced mogul denied the man’s story, In Touch can exclusively report.
According to court documents obtained by In Touch, Derrick Lee Cardello-Smith, who is locked up in a Michigan prison, slammed Diddy, 54, and his team for moving his lawsuit to federal court.
Derrick asked the court to remand the case down to state court. In his motion, he accused Diddy of conspiring with third parties to prevent him from obtaining “justice” in the matter.
The prisoner asked the court to allow him to appear for a video conference from prison to explain his case. In a separate filing, Derrick revealed he is seeking $400 million in damages against Diddy for “monetary, punitive and compensatory damages.”
In June, Derrick filed his lawsuit against Diddy. He claimed to have met the entertainer while working as a bartender in Detroit in 1997. Derrick said Diddy invited him to a sex party at a Holiday Inn.
In his suit, Derrick claimed Diddy sexually assaulted him at the party. He said Diddy gave him a drink and told him he had “added a little something to it for you.”
Derrick claimed he woke up hours later to Diddy having sex with a woman in front of him. He said Diddy turned to him and told him, “I did this to you too!” In court documents, Derrick said he tried to file a police report but was shut down.
In September, a judge granted Derrick a $100 million default judgment after Diddy failed to respond to the case. A couple of weeks later, Diddy’s team asked the court to vacate the judgment. The judge agreed and allowed Diddy time to respond to the suit.
The team argued it was not aware of the lawsuit. As In Touch first reported, earlier this month, Diddy’s lawyers argued that Derrick’s claims were implausible.
Diddy’s lawyer claimed Derrick had made up a “fantastical set of allegations that numerous high-ranking [government] officials engaged in a vast cover-up with [Diddy].” The lawyer added, “incredibly, in two different complaints filed in two different courts, [Derrick] alleges that this purported assault occurred in two different counties on the same day.”
“[Derrick] baselessly asserts that the [Diddy] sexually assaulted him on June 14, 1997, somewhere in Michigan,” Diddy’s motion read.
“Because the assault allegedly occurred in June 1997, any claim [Derrick] might have had expired in June 2000—more than two decades before [Derrick] commenced this litigation. For this reason alone, the court should dismiss the complaint in its entirety with prejudice,” the filing argued.
Diddy’s attorney, Marc Agnifilo, previously told TMZ about the case, “This man is a convicted felon and sexual predator who has been sentenced on 14 counts of sexual assault and kidnapping over the last 26 years. His resume now includes committing a fraud on the court from prison, as Mr. Combs has never heard of him let alone been served with any lawsuit. Mr. Combs looks forward to having this judgment swiftly dismissed.”
As In Touch previously reported, Diddy has remained behind bars since his September 16 arrest on charges of sex trafficking and racketeering.
