Diddy asked a federal judge to award him sanctions against the male prisoner suing him over an alleged sexual assault that the mogul claims never happened, In Touch can exclusively report.
According to court documents obtained by In Touch, Diddy, 55, and his legal team demanded the court stop Derrick Lee Cardello-Smith’s lawsuit from moving forward.
Diddy’s lawyer pointed out that Derrick is currently “serving a decades-long sentence” and accused him of “attempting to leverage the federal judiciary as a tool for harassment and extortion.”
They point out, “[Derrick] has filed several, substantially identical lawsuits against [Diddy], in each case demanding enormous sums of money based on wholesale fabrications.”
Diddy’s lawyer continued, “His frequent filings clearly indicate he has no intention of stopping his meritless attacks. As a result of [Derrick’s] harassment, [Diddy] has incurred significant legal fees and costs. [Derrick’s] barrage of meritless, fraudulent filings must come to an end.”
Diddy asked that the court order Derrick to stop bringing, without prior court permission, any new filings. Further, the entertainer asked that Derrick be ordered to pay his legal fees in the case.
Diddy’s lawyer claimed, “This is not [Derrick’s] first attempt at a shakedown — and unless this Court intervenes, it will not be his last. [Derrick] has a lengthy history of filing frivolous lawsuits in this District and beyond.”
“The overwhelming majority, if not all, of [Derrick’s] cases have been dismissed as meritless. Still, he has continued filing. Numerous judges have admonished [Derrick] to stop litigating vexatiously,” Diddy’s lawyer pointed out.
As In Touch previously reported, Derrick sued Diddy over an alleged assault in 1997.
Derrick said he met the musician while working as a bartender. He claimed Diddy invited him to a sex party at a hotel. In his lawsuit, Derrick claimed Diddy offered him a drink at the party and told him he “added a little something” to it for him.
Derrick said he fell asleep and woke up to Diddy having sex with a woman in front of him. Derrick claimed Diddy looked at him and told him, “I did this to you too!”
In his suit, Derrick accused government officials of working with Diddy to cover up the alleged crimes. Diddy’s lawyers have scoffed at the allegations for months.
Diddy’s attorney argued, “Incredibly, in two different complaints filed in two different courts, [Derrick] alleges that this purported assault occurred in two different counties on the same day.”
In addition, Diddy’s team said the claims were brought way past the statute of limitations.
Diddy’s lawyer previously said about the lawsuit, “This man is a convicted felon and sexual predator who has been sentenced on 14 counts of sexual assault and kidnapping over the last 26 years. His resume now includes committing a fraud on the court from prison, as Mr. Combs has never heard of him let alone been served with any lawsuit.”
As In Touch first reported, earlier this month, Derrick filed documents claiming he planned to call Diddy’s ex Jennifer Lopez as a witness in the case. He said he believe she had relevant information since she dated Diddy from 1999 to 2001.
Diddy has remained behind bars since his September 16 arrest on charges of sex trafficking and racketeering. He pleaded not guilty to all charges.
