Halle Berry submitted a bombshell declaration in court as she attempts to strip her ex-husband, Olivier Martinez, of legal custody of their 11-year-old son, Maceo.
In Touch obtained the emotional declaration that Halle, 58, filed as part of the never-ending court battle with Olivier, 58.
The exes wed in 2013 and split in 2016. Their divorce dragged on for years and wasn’t finalized until late 2023.
Months later, Halle was back in court accusing Olivier of failing to follow the terms of their divorce settlement. She asked the court to award her full legal custody of Maceo, which would allow her to make all important life decisions for the child.
Olivier opposed the request. He accused Halle of using her wealth to drag him in and out of court.
In her declaration, Halle laid out her case for full legal custody ahead of the upcoming court hearing where she’ll face off with Oliver.
She said, “I believe that Olivier is not a cooperative coparent. I have experienced and perceived Olivier to have poor parental judgment.”
Halle continued, “Based on our communications, I believe his spite for me interferes with his ability to think rationally and engage in non-hostile, productive and peaceful communications. Olivier continues to engage in aggressive and non-productive discussions which oftentimes end with him threatening and disparaging me. Olivier’s behavior delays required decision-making for Maceo and interferes in critical and time-sensitive interventions.”
Halle said she has tried to resolve the issues with Olivier for months but her efforts have been unsuccessful.
The actress said she refutes Olivier’s claims he has been cooperate with her. She said it took three years, two mediations and extensive attorney involvement for Olivier to agree that their son see a therapist.
She said it took two years, two mediations and attorneys to get a decision made on Maceo’s education. She said reaching these deals cost hundreds of thousands of attorney fees and costs. Halle said it also cost the “passage of time (anywhere from months to years) which in turn delayed” important decisions for Maceo.
Halle said Olivier has interfered with their son’s growth and she wants to stop it by stripping him of legal custody.
“I have never once stated or even intimated that I would ever send Maceo to boarding school or a residential treatment facility. This was made clear to Olivier’s lawyers. For years, I have fought for every single moment of make-up time for the custody time I have been forced to lose for work-related reasons. I have spent thousands of dollars fighting for orders relating to make-up time.”
Halle also accused Olivier of keeping her in the dark about Maceo’s soccer events. “I did not go to practice or games because Olivier refused to provide me with the information,” she said.
Olivier filed a fully redacted declaration in the case.
A lawyer for Olivier tells In Touch, “in order to protect Maceo, [Olivier] will not be providing public comment even though he has addressed every allegation directly with [Halle].”
As In Touch first reported, Halle accuses two of her ex-employees of conspiring with Olivier to make “false reports” about her. One of the ex-employees will be grilled by Halle at the upcoming hearing.
