Jaime King’s court battle with ex-husband Kyle Newman over custody of their two children now involves the Department of Children and Family Services, In Touch can exclusively report.
According to court documents obtained by In Touch, the judge presiding over Kyle’s petition for a restraining order against Jaime, 45, revealed the bombshell at a court hearing on Monday, November 18.
A minute order from the hearing noted, “The court learns that Department of Children and Family Services are involved with the case.” The order also noted there are no temporary orders in effect.
Jaime and Kyle, 48, were not present, but their lawyers were at the hearing. Kyle’s attorney told the court that his client had not been able to serve Jaime with a notice of the court hearing.
As a result, the hearing on Kyle’s request for a restraining order and sole custody was pushed to January 13, 2025.
As In Touch first reported, last month, Kyle rushed to court accusing Jaime of neglecting their sons, James Knight and Leo Thames, while they were in her care.
He demanded that the actress submit to drug and alcohol testing. Jaime and Kyle were married from 2007 and split in 2020.
In his recent petition, Kyle asked the court to award him sole custody.
He said, “The children are currently in danger when in their mother’s care. Jaime King is suffering from drug and alcohol addiction and is emotionally abusing and neglecting our children; placing them in danger and exposing them to many disturbing people and situations, including sexual content. The children are begging me to help rescue them from the chaos in their mother’s home.”
Kyle proposed that Jaime have limited supervised visitation. In his declaration, Kyle told the court his ex had has a history of “severe drug and alcohol abuse and has had a major relapse endangering the safety and wellbeing of our children in her custodial care.”
Kyle said he received a call from his sons on October 17, begging him to come to Jaime’s home and pick them up.
In a declaration, Kyle told the court, “I arrived [at] Jaime’s house around 7:45 a.m. I knocked on the door and was greeted by the boys. I went inside and I saw Jaime sitting on her knees on the floor, wearing a navy blue and white varsity, her hair was in pigtails and she appeared to not be wearing any pants (or maybe had short shorts on). There were two men there.”
He continued, “Jaime looked distressed, strung out and was acting drunk. She gestured for me to come over to her because she tried to get up but could not stand. Jaime was slurring her words and said, ‘Those are bad boys.’ We have to do something about our boys. Their behavior is not right.'”
Kyle also said the boys told him, “Jaime and her friends frequently smoke inside the house with the doors and windows closed,” with them around.
He said, “The children repeatedly ask her not to and mention the dangers they read about smoking on the American Cancer Society site. One night in June, they opened the door for fresh air. She blew the smoke in both their faces and said, ‘That website is propaganda,’ and laughed and continued to smoke inside the house near them and closed the door.”
Kyle added, “Jaime loves our children and we want her to get help — I am, however, unable to force her to get help and cannot allow our children to be in a constant state of danger and abuse as a result of Jaime’s addiction issues.”
The actress’ lawyer, Diana D. Hagopian, previously told In Touch, “Mr. Newman’s [previous] ex parte requests have been denied in their entirety by the court.”
“The allegations against Jaime are entirely false and intended to cause her harm and garner damaging media attention,” Diana said in regard to Kyle’s claims in his recent petition.
Diana said, “It is unfortunate that Mr. Newman continues to utilize the court in attempt to continue … the filing of unfounded malicious claims and to use the children as weapons and pawns without regard to their privacy.”
She ended, “Jaime is intent and solely focused on a peaceful and harmonious coparenting process and her utmost priority is the happiness, health, and well-being of their children.”
Kyle’s lawyer, Garry Gekht, previously told In Touch, “Kyle’s only wish is that Jaime finally gets the help she needs to that she can be a safe, healthy and appropriate parent to the parties’ children, and again asks for privacy, both from the media and from Jaime and her new attorney, for the sake of the children who continue to be in his exclusive care and remain his sole focus.”
