After nearly two years of legal wrangling, a couple who sued the construction companies owned by HGTV stars Dave and Jenny Marrs in February 2023 reached a last-minute settlement agreement on January 24, 2025, according to court documents reviewed by EntertainmentNOW.
After multiple delays, the case was scheduled to go to trial on January 27. But an undisclosed settlement arrangement was reached the Friday before, on Jenny’s birthday.
Though neither of the Marrs have commented publicly on the end of their long legal drama, Jenny wrote in a reflective birthday post that day, “This last year was all about facing fears and saying YES. It was a year full of adventure and joy and fear and tears and abundant grace. It was a year where God faithfully showed up time and time again. 🤍”
Clients Claimed in Lawsuit That Dave Marrs ‘Refused’ to Conduct Repairs on New Home
On February 7, 2023, Matthew and Sarah McGrath of Bella Vista, Arkansas, filed a lawsuit against two companies owned by the “Fixer to Fabulous” stars, Jupiter Rentals and Marrs Construction.
According to the website for Marrs Developing, the Marrs’ teams have built approximately 30 homes per year since 2004 in Northwest Arkansas. In the lawsuit filed by the McGraths and reviewed by EntertainmentNOW, the couple said they purchased one of those newly constructed homes in May 2022 for $559,000, but claimed they found serious defects upon moving in.
The McGraths claimed that they worked directly with Dave Marrs to purchase the home and that he had “refused” to conduct any updates or repairs to the house as promised. Marrs and his associates pushed back on many of the McGraths’ claims and said that the couple wouldn’t allow them access to the home to make any needed repairs.
In March 2024, a new court filing by the McGraths listed nearly two dozen code violations based on contractors’ inspection of the property, according to local CBS affiliate 5News. When Marrs sat down for a deposition in August, he took issue with the list of issues and argued that some of the recommended repairs would have caused more harm than good to the house.
After a flurry of activity in the days before the January 27 trial date, including subpoenas ordering multiple witnesses to appear in court, a Joint Stipulation of Settlement of All Claims was filed in the Circuit Court of Benton County.
The document states that “all pending claims which are now or may be asserted by any party have been fully compromised by settlement, and upon consummation of settlement, the pending claims in the above-styled lawsuit will be dismissed with prejudice.”
