According to Capitol police, officers witnessed Tarrio strike the protester's cellphone and arm after she placed the phone close to his face as they walked near the Capitol. Tarrio had just left a news conference that had ended "without incident," police said.
"The woman told our officers that she wanted to be a complainant, and the man was arrested for simple assault," police stated.
Tarrio, of Miami, had been serving a 22-year sentence—the longest among hundreds of Capitol riot cases—until last month, when President Donald Trump granted clemency to over 1,500 individuals charged in connection with the attack.
A jury previously convicted Tarrio and three of his lieutenants of seditious conspiracy, finding they orchestrated a violent plot to block the peaceful transfer of power from Trump to President Joe Biden following the 2020 election.
On Friday, Tarrio attended a press conference alongside other Proud Boys and Oath Keepers founder Stewart Rhodes, who was also convicted of seditious conspiracy but had his 18-year sentence commuted by Trump last month.
