Halle Berry demanded ex-husband Olivier Martinez be ordered to pay $455,000 for his behavior in their bitter custody battle — only weeks after he claimed he had to sell his Rolex to pay his lawyers, In Touch can exclusively report.
According to court documents obtained by In Touch, Halle, 58, asked the court to deny Olivier’s plea for $360,000 to help pay his legal team. Halle and Olivier, 58, wed in 2013 and split in 2016. They share a 10-year-old son, Maceo.
The divorce dragged on for years until the divorce was finalized in late 2023.
Per the judgment, Halle was ordered to pay Olivier $8,000 a month. The court ruled they would share custody. The agreement also stated that Olivier and Halle were to attend coparenting therapy sessions.
Months later, Halle accused Olivier of blowing off scheduled therapy sessions. On top of that, she accused him of conspiring with her former employee in an attempt to influence their son’s therapist. She pleaded with the court to step in.
A couple of weeks later, Halle asked the court to grant her sole legal custody of Maceo. She claimed Olivier’s behavior warranted her being the sole decision-maker when it came to their son’s education and health. Olivier opposed the request.
Olivier pleaded with the court to postpone the hearing to allow him time to build his defense. He claimed Halle was using her fortune to drag him in and out of court.
He demanded Halle cough up money for him to continue fighting her in court. He said he recently paid his new law firm $55,000. Olivier said he had to sell a Rolex watch and take out a $45,000 loan to make the payment.
In her new motion, Halle asked the court to deny Olivier’s request completely. She asked the court to order Olivier to pay her $455,509.79 in monetary sanctions for “Olivier’s litigation conduct to date and to incentivize him to cooperate and reduce the costs of litigation in the future.”
Halle’s lawyer called Olivier “willingly unemployed” and said he was someone who “acted in bad faith and engaged in actions that have unnecessarily escalated litigation.” Halle said she already paid Olivier $80,000 for legal fees.
The actress said her ex has acted “irrational and unreasonable” in the past four years.
She said he has interfered with their son’s growth and ignored the recommendations of professionals hired to help their son thrive. The lawyer also claimed Olivier had “admitted to live off the child support he receives from Halle.”
Her lawyer continued, “While it is true that Halle was the one to initiate mediation and this post-judgment proceeding, none of it would have been necessary if Olivier had simply come to the table as a parent and addressed time-sensitive and necessary issues for Maceo. It would have cost Olivier nothing to comply with his own agreements, follow the recommendations of Maceo’s providers, or co-parent with Halle.”
They added, “Halle should not be forced to pay for Olivier’s unreasonable conduct when he is the sole reason why the fees and costs have escalated in this case.”
A hearing was held this week. The judge ruled Olivier needed to attend the coparenting therapy sessions. The issue of attorney fees and sanctions was not addressed.
The judge set another hearing for December.
