A witness has testified in front of a grand jury in the case against Sean “Diddy” Combs, claiming to have physical evidence to back up their allegations. According to TMZ, Courtney Burgess took the stand on Thursday (Oct. 31) and claims he was contacted by agents from the Department of Homeland Security to appear in court.

He claims to “not personally” know Combs, but is affiliated through his work in the music industry and relationship with Frank Lucas. Burgess’ lawyer, Ariel Mitchell, informed the tabloid that her client was subpoenaed for the case. He also claims to have the authentic, unedited version of the diary allegedly written by the late Kim Porter, as well as video evidence.

“It was the book,” says Mitchell of the alleged words of Porter on a flash drive he has possession of. “Nobody altered it or nothing,” added Burgess. Together they asserted the memoir released earlier this year and slammed by Porter’s friends and family was “edited.” The work titled Kim’s Lost Words, published by Chris Todd has been removed from Amazon.

“A lot of stuff their mother did, they didn’t know,” alleges Burgess, offering an apology and questioning why the family did not speak out against the alleged abuse Porter faced at the hands of Combs. Mitchell says she has been contracted to go to Amazon to republish the “actual unedited version.”

“Claims that our mom wrote a book are simply untrue. She did not. And anyone claiming to have a manuscript is misrepresenting themselves,” shared a joint statement from Porter’s children after the now-removed memoir was released. “Please understand that any so-called ‘friend’ speaking on behalf of our mom or her family is not a friend, nor do they have her best interests at heart.”

According to Eboni Elektra, a close friend of Porter, “Kim Porter never drafted nor wrote a book, memoir, or manuscript.” She exclaimed on social media, “Now it’s getting out of hand. THERE IS NO BOOK! There never was. Several people continue to speak about and spread blatant lies regarding this ‘mystery manuscript’ as if it were true. People… IT’S NOT. Kim would never do such a thing, and that’s the honest to God truth. The truth is the truth. Be blessed.”

Mitchell also informed the tabloid that there is an additional hearing to determine what they would be forced to turn over to government agencies. Per TMZ, this includes thumb drives, hard drives, electronic storage devices, or devices containing videos and/or other files.

According to a previous VIBE report, Mitchell claimed that a “more high-profile” person was featured in one of Combs’ pornographic videos. In addition to Burgess, she also represents an unnamed accuser who detailed her alleged assault by Combs.

“We are disappointed with the decision to pursue what we believe is an unjust prosecution of Mr. Combs by the U.S. Attorney’s Office,” detailed Combs’ lawyer, Marc Agnifilo. “Sean ‘Diddy’ Combs is a music icon, self-made entrepreneur, loving family man, and proven philanthropist who has spent the last 30 years building an empire, adoring his children and working to uplift the Black community. He is an imperfect person but he is not a criminal.”

Combs was arrested this September and faces charges of racketeering conspiracy; sex trafficking by force, fraud, or coercion; and transportation to engage in prostitution.

Earlier this week, the disgraced Hip-Hop mogul was accused of drugging and raping a 10-year-old boy during an audition, as well as forcing another to perform sexual acts. The civil suit claims that the alleged victim encountered Combs during an audition in a New York City hotel room in 2005. An additional plaintiff alleges in a separate lawsuit, that he was 17 when he was assaulted by Combs while auditioning for the MTV reality series, Making the Band.

“As we’ve said before, Mr. Combs cannot respond to every new publicity stunt, even in response to claims that are facially ridiculous or demonstrably false,” Combs’ attorneys said in a statement. “Mr. Combs and his legal team have full confidence in the facts and the integrity of the judicial process.  In court, the truth will prevail: that Mr. Combs never sexually assaulted or trafficked anyone—man or woman, adult or minor.”
