Rapper French Montana was hit with a massive default judgment after he blew off a lawsuit over a vicious dog attack that left a man injured, In Touch can exclusively report.
According to court documents obtained by In Touch, the alleged victim of the dog attack, Jason Leyva, was awarded a $403,644.39 default judgment against French, 39, on Tuesday, October 28.
The breakdown of the judgment is $400,225 for damages and another $2,419 for additional costs. The amount is substantial but a far cry from the $2.3 million that Jason was initially seeking in his lawsuit.
The lawsuit has been dragging on for years. Jason filed his lawsuit in 2021 in Los Angeles Superior Court.
His lawsuit read, “Prior to November 3, 2019, [Jason] was hired and invited by or on behalf of Defendants to perform landscaping services on the Premises. On November 3, 2019, [Jason] entered the Premises where the incident occurred.” “On November 3, 2019, Defendants and each of them were aware that the Dog was outside its cage and, carelessly and without regard to the safety and wellbeing of invitees such as [Jason], allowed the Dog, with known and foreseeable vicious propensities and physiognomies, to roam freely, uncaged and unsecured,” his lawsuit added. “Defendants failed to have the dog under restraint or to take any other precautions to prevent the dog from attacking [Jason] or other persons or to warn invitees of the danger posed by the Dog,” the suit continued. “This careless action created a known and foreseeable dangerous condition within the premises.”
Jason accused French of failing to keep his dog from attacking others.
“Defendants and each of them negligently maintained upon the Premises a Dog of a species known to cause injury to people, and specifically used the Premises to house a Dog that Defendants specifically knew or had reason to know had dangerous propensities. Despite this clear knowledge that the Dog was dangerous, Defendants negligently failed to keep the Dog under restraint and instead let the Dog roam around during hours in which were known guests and/or workers would be inside the Premises,” the lawsuit added. Jason said he suffered physical injuries which caused him pain and suffering.
His lawyer claimed, “As a result of the conduct of Defendants, and each of them, [Jason] has been unable, and will continue in the future to be unable, to attend to his normal occupations, resulting in a loss of earnings and earnings capacity, to his damage, as will be established at the time of trial.
Back in 2023, Jason asked for permission to serve French by posting an advertisement in the newspaper due to him being unable to serve the rapper.
For months, Jason has attempted to obtain a default judgment but was unsuccessful until this week. French has yet to comment on the matter.
French Montana’s friend Diddy has had his own legal problems. Diddy, 54, has been behind bars since September 16 after being arrested on charges of sex trafficking and racketeering. He pleaded not guilty to all charges.
The disgraced mogul was denied his plea for bond and is currently locked up in a Brooklyn prison awaiting trial.
