TikTok is running out of options to avert its impending US ban. But one of the only sources of hope left for TikTok has just come through. The US Supreme Court has agreed to hear TikTok’s arguments against the forthcoming ban. Here are the details.
US Supreme Court will hear TikTok’s challenge January 10
Per legislation passed by the US Congress and signed by President Biden, TikTok will soon be banned in the US unless ByteDance sells its US stake in the social app.
Up until now, ByteDance’s various challenges have all come to nothing.
But there’s one more legal avenue for averting the impending ban: the US Supreme Court.
Today, the Supreme Court formally agreed to hear the case on Friday, January 10, 2025.
There will be a total of two hours allotted for oral arguments from TikTok and its legal opponents.
Each side also has several deadlines to meet ahead of time.
Per the Supreme Court’s memo:
The parties are directed to file electronically simultaneous opening briefs, limited to 13,000 words, and a joint appendix on or before 5 p.m. (EST), Friday, December 27, 2024. Reply briefs, limited to 6,000 words, are to be filed electronically on or before 5 p.m. (EST), Friday, January 3, 2025. Any amicus curiae briefs are to be filed electronically on or before 5 p.m. (EST), Friday, December 27, 2024.
The January 10 hearing date doesn’t provide much cushion before the January 19 deadline.
It’s possible the Supreme Court will expedite its decision following the January 10 hearing, but it would still be unusual to have a judgment passed down near-immediately.
Another factor in this discussion is President-elect Donald Trump, who has indicated he might try to undo the ban if possible. He will be inaugurated the day after the January 19 deadline.
In any case, the Supreme Court’s involvement is good news for TikTok and owner ByteDance. It means there’s hope yet for their legal case.
